These Terms of Service (the "Terms") are a legal agreement between you and Mehmet Ali Çopurlar ("On That Day", "we", "us") governing your use of the On That Day mobile app and related services (the "App"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use On That Day. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or legal guardian who agrees to these Terms.
You are responsible for the activity on your account and for keeping your recovery passphrase and devices secure. Because your content is end-to-end encrypted, we cannot recover your content or your account if you lose your recovery credentials — keep them safe.
You keep all rights to the photos, voice notes, text, and other material you add ("Your Content"). You grant us a limited, worldwide license to store, transmit, and process Your Content in encrypted form solely to operate the App and to deliver it to the people you share a capsule with. We do not claim ownership of Your Content and do not use it for advertising. You are responsible for Your Content and for having the rights to share it.
We have zero tolerance for objectionable content and abusive behavior. You agree not to use On That Day to create, upload, share, or transmit content, or to engage in conduct, that:
Reporting and enforcement. You can report a memory and block other members from within the App. We review reports and, at our discretion, may remove content, suspend, or permanently terminate accounts that violate these Terms, with or without notice. We aim to act on valid reports promptly (generally within 24 hours). Because content is end-to-end encrypted, we assess reports using metadata and signals and enforce by removing content by reference and by taking account action — we do not need to view content to act.
We may remove content or restrict accounts to comply with the law, enforce these Terms, protect users, or protect the App. We are not obligated to store or maintain Your Content and may delete content associated with a removed item, suspended account, or deleted account.
You may stop using On That Day and delete your account at any time from within the App. Deletion is immediate and irreversible, and permanently erases your content and the capsules you solely own. We may suspend or terminate your access if you violate these Terms or if necessary to protect the App or its users.
The App is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that content will always be available or recoverable.
To the fullest extent permitted by law, Mehmet Ali Çopurlar will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, content, or profits, arising out of or related to your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim or USD 50.
These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws rules. Disputes will be subject to the courts of Amsterdam, the Netherlands, unless applicable law provides otherwise. Nothing in this section deprives you of the protection of mandatory consumer-protection laws of the country where you reside.
If you download the App from the Apple App Store, you acknowledge that these Terms are between you and Mehmet Ali Çopurlar only, not Apple, and that Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the App must also comply with the Apple Media Services Terms and the standard Apple Licensed Application End User License Agreement, which apply in addition to these Terms.
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, for material changes, provide additional notice where appropriate. Continued use of the App after changes take effect means you accept the updated Terms.
